NHS Defered member accruals

Hi all
Is anyone fairly confident around the above scenario? Got myself in a bit if a muddle trying to work out if client has accrued (pension input) or not!

Client was a member of 1995 scheme and 2015 scheme.

He ceased being a member of 95 scheme in April 22 and was deferred till Jul 31st when the pension came into payment.

He was also a member of the 2015 scheme during this time, leaving July 31st 2022.

He has now re-joined the NHS and is in the AE NEST scheme.

I'm trying to establish if he will have an AA charge by trying to work out his accruals April 22- July 22.

I believe he may be a 'deferred member carve out' in relation to the 1995 scheme and perhaps the 2015 scheme (but accruals will be v low here anyway).

Can anyone confirm if he would be a carve out candidate and if not, can we find out the relevant percentage/statutory increases? These seem to be the relevant statutes but I'm getting a bit out my depth now!

  • You need to look at each arrangement separately and whether they are active or deferred is a matter of fact based on the circumstances.

    The 95 section appears deferred, the 2015 does not.

    But I'm by no means an NHS pensions expert

  • If a member retains an 'employment link' to a DB scheme that's closed to future accrual eg a salary link, then the carve-out isn't applicable.

    Yes, if your service is stagnant but you have a link to a final salary then you're clearly an active member.
